It is established that the constitutionally anchored employment interests of both parties can only be realized if employment law is applicable. This cannot be the case in the absence of an employment relationship. At present the constitutionally required minimum level is not met in the case of forced employment during legal litigation, so the state must take action by way of its duty to protect.
